The American Bankruptcy Institute (ABI) released the fourth edition of its ABI Healthcare Insolvency Manual, which addresses the increasing financial distress surrounding healthcare providers. Over the past three decades, the healthcare industry has undergone transformation driven by changing reimbursement models, demographic shifts, statutory and regulatory developments, workforce shortages, rising labor and operating costs, technological innovation, increasing consolidation, and unprecedented events such as the COVID-19 pandemic. The fourth edition provides case law, practical tips and explanations of both the relevant Bankruptcy Code sections and the intricacies of the healthcare profession.
Dozens of authors from several firms and the U.S. Bankruptcy Court contributed to the book. Leslie Ann Berkoff of Moritt Hock & Hamroff LLP (Garden City, NY) and J. David Folds of Baker, Donelson, Bearman, Caldwell & Berkowitz, PC (Washington, DC) edited the fourth edition. The manual is a resource for bankruptcy practitioners dealing with a healthcare entity — such as a nursing home, hospital or HMO — that is nearing insolvency. It also explores some bankruptcy alternatives available to the healthcare debtor and the steps to take when fraud and abuse are uncovered.
